Terms and Conditions of Entry for Elysia Wellness Retreat “More Time More Joy* (“Competition”)

These are the terms and conditions of entry, including, without limitation, information on how to participate and the prize or promotion details, applying to the Competition. .

1. The promoter is Minor Hotels Australasia Limited (ACN 113 972 366) of Level 26, 266 George Street, Brisbane, Queensland 4000 (“Promoter”).

2. The Competition will be open from 4.00pm (AEST) on 7 October 2025 until 11.59pm (AEST) on 31 October 2025 (“Competition Period”).

3. Entries received by the Promoter after the Competition Period are ineligible for the prize draw.

4. By entering this Competition, participants are deemed to accept these terms and conditions.

5. If there is any inconsistency between these terms and conditions and any other published material that refers to this Competition, these terms and conditions will prevail.

Eligibility and Participation

6. Entry in the Competition is only open to Australian residents aged 18 years and over, excluding:

a. management, employees, directors and contractors of the Promoter, its related bodies corporate, agencies, firms or companies associated with the Competition (including suppliers of prizes);

b. a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these terms and conditions;

c. persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and

d. persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,

(“Eligible Entrant”).

7. The Promoter’s decision on whether a person is eligible to enter or participate in the Competition is final and may be determined in the Promotor’s absolute discretion.

8. To enter the Competition, an Eligible Entrant must, during the Competition Period, book an all-inclusive program at Elysia Wellness Retreat via the website: https://www.elysiaretreat.com.au/programs/all-inclusive-programs.

9. An Eligible Entrant who submits an entry in accordance with these terms and conditions will automatically receive one (1) entry into the Competition (“Eligible Entry”). Eligible Entries are deemed to be entered into the Competition at the time of receipt by the Promoter. Only one entry per Eligible Entrant is permitted.

PRIZE

10. Eligible Entrants who submit an Eligible Entry will go in the draw to win one $1,500 (Incl. GST) JSHealth Vitamins gift voucher (“Prize”). Prize value is in AUD.

11. Prize is not transferable or exchangeable and cannot be taken as cash and is not redeemable for other benefits. The Competition is not available in conjunction with any other offer.

12. If any Prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the prize) with a prize to the equal value, subject to any written directions from a regulatory authority.

PRIZE DRAW

13. The Prize draw will be drawn by the Promoter at 4pm AEST on 5 November 2025 from all Valid Entry’s received (“Draw”) to select one winner (“Winner”).

14. This is a game of chance. The Winner will be the first valid and Eligible Entry drawn manually via random selection from the cumulative pool of all Eligible Entries received by Promoter.

15. The Winner will be notified within 48 hours via email or phone using the details supplied when entering the Competition. To accept the Prize, Prize winners must respond to the notification in the manner and within the timeframe set out in the notification provided by Promoter informing them of the fact they are a Prize winner.

16. The Prize will be sent electronically and emailed to the Winner.

17. If the Winner cannot be contacted or fails to respond to any attempted contact within 48 hours of the Draw, such Winner will be disqualified, their entry will be declared null and void and a new Winner will be re-drawn from the remaining Valid Entries. This process will be repeated until a Winner is successfully contacted.

18. Redemption and use of the Prize is subject to any terms and conditions of JSHealth Vitamins including those specified on the Prize by JSHealth Vitamins. JSHealth Vitamins is not a participant in, or promoter or sponsor of, this Competition.

19. All Eligible Entrants agree that if they win the Prize, they will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the Internet. Photographs will be allowed only at the discretion of the Promoter.

LIABILITY

20. The Promoter accepts no responsibility for any late, lost or misdirected entries nor any liability for lost, missing or damaged Prizes (as applicable).

21. The Promoter is not responsible for any ancillary costs incurred by accepting the Prize, entering the Competition or redemption of the Prize.

22. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under similar consumer protection laws in Australia (“Non-Excludable Guarantees”).

23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, agents and related parties) is not responsible for, and excludes all liability (including negligence) whether direct, indirect, special or consequential, arising in any way out of the Competition and/or:

(a) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(b) any tax liability incurred by a winner or entrant; or

(c) taking of the Prize.

24. The Promoter accepts no responsibility or liability for the Prize being intercepted fraudulently and being used by someone other than the Winner.

25. Except for any liability that cannot by law be excluded, the Promoter’s liability in connection with these terms and conditions, and the Competition, is limited to $1,500 AUD.

PRIVACY

26. The Prizes are issued by JSHealth Vitamins. The Promoter will be required to provide some of the Eligible Entrants’ personal information to JSHealth Vitamins in order for the Prize to be issued. By entering the Competition, entrants agree that their personal information may be used in this manner.

27. All entries submitted will become property of the Promoter and entries will not be returned.

28. In entering this Competition, all entrants consent to the publication of their name and city of origin in any advertisements or articles relating to the Competition or the Prize and participate in any media releases which may include photographs of the Winner by the Promoter. In entering this Competition, all entrants consent to the use of their names and likeliness in this manner.

29. The personal information you provide will be collected and may be used by the Promoter and its associated companies for any promotional, marketing and research purposes and held in accordance with our Privacy Policy, which can be viewed on our website https://www.elysiaretreat.com.au/privacy-policy

30. By entering the Competition, entrants consent to the use of their personal information as described in these terms and conditions. Entrants may access, change and/or update their personal information , or opt of out receiving marketing material, by contacting the Data Protection Officer on privacy.corporate@minorhotels.com.au.

GENERAL

31. The Competition and these terms and conditions, are governed by the laws of Australia and all entrants and the Promoter submits to the exclusive jurisdiction of Australia.

32. This Competition may be withdrawn by the Promoter at any time prior to the Draw.
